Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Resume.win website (https://resume.win), applications, and related services (collectively, the "Service") operated by Wackywow.com LLC ("we," "us," or "our"), doing business as Resume.win. By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years old and capable of forming a binding contract to use Resume.win. By using the Service, you represent that you meet these requirements and that all registration information you provide is accurate and current.

The Service is intended for individual job seekers and personal career management. Use on behalf of an organization requires written authorization from us. You may not use the Service if you have been previously suspended or removed.

Resume.win is an all-in-one career platform that may include, depending on your plan:

• Apply Kit workflow: paste a job, tailor resume, ATS review, cover letter, and mark Applied
• Job application tracking, pipelines, outcomes, and follow-up tools
• Resume builder, private file storage, parsing, export, and version management
• Shareable Apply Packs you create for coaches, referrals, or review
• Optional employer-interest bridge (opt-in only) with a sister product, Recruit.win
• AI-assisted resume review, tailoring, bullet generation, and related writing tools
• Contact and networking management tied to your job search
• AI mock interviews, including optional video sessions and recordings
• Subscription plans with usage limits and premium feature access
• Account settings, privacy controls, billing, and customer support

We may add, modify, or discontinue features at any time. Beta or experimental features may be offered "as is" with limited support. Resume.win is a seeker-facing product; it is not a job board marketplace and does not guarantee employment.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

• One person per account unless we approve a team or enterprise arrangement
• You may not share credentials or sell access to your account
• You must keep your email verified and profile information accurate
• We may suspend accounts that violate these Terms or pose security risks

5.1 Paid plans

Paid subscriptions are billed in advance on a recurring basis (typically monthly) through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for applicable fees, taxes, and renewals until you cancel.

5.2 Price changes

We may change plan prices or features with reasonable notice. Changes apply to the next billing cycle after notice, unless otherwise required by law.

5.3 Cancellation

You may cancel at any time through account settings or the Stripe customer portal. Cancellation stops future charges; access to paid features continues until the end of the current billing period unless stated otherwise.

5.4 Failed payments

If payment fails, we may downgrade your account, restrict features, or suspend access until payment is resolved.

Free trials or promotional access may be offered at our discretion. When a trial ends, your selected paid plan may begin automatically unless you cancel before the trial period expires—check the offer terms shown at signup.

Except where required by law or explicitly stated in a promotion, fees are non-refundable once charged. If you believe you were billed in error, contact [email protected] within 30 days with your account email and transaction details.

You agree not to misuse the Service. Prohibited conduct includes:

• Violating laws, regulations, or third-party rights
• Uploading malware, spam, or harmful code
• Scraping, reverse engineering, or circumventing access controls (except as permitted by law)
• Impersonating others or misrepresenting your identity or qualifications
• Using the Service to harass, discriminate, or publish unlawful content
• Reselling, sublicensing, or commercially exploiting the Service without permission
• Automated access that burdens our infrastructure (bots, bulk scraping) except via documented APIs we provide
• Submitting others' personal data without lawful basis and consent
• Harvesting or redistributing other users' resumes, Apply Packs, or contact details without authorization
• Using $Resume.win branding, logos, or domain to impersonate us or confuse users of sister products
• Attempting to access another user's private files, accounts, or non-public Apply Packs

We may investigate violations and cooperate with law enforcement. Violations may result in content removal, suspension, or termination.

You retain ownership of resumes, job notes, contacts, interview responses, and other materials you submit ("User Content"). You grant Resume.win a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display User Content solely to operate, improve, and secure the Service—including running AI features you request.

We do not claim ownership of your career materials. We do not sell your resumes or contact information. Optional sharing (Apply Packs, employer interest) happens only when you enable it or create a share link.

You represent that you have all rights necessary to submit User Content and that it does not infringe intellectual property or privacy rights. You are solely responsible for the accuracy of resumes and applications you send to employers.

Apply Packs are links you create to share selected application materials (for example cover preview and resume view) with people you choose. Packs may expire and can be view-counted. You are responsible for who you share links with.

• You may revoke opt-in at any time in Settings
• Public Apply Pack pages should not be treated as a job marketplace listing
• Do not use packs to spam employers or collect personal data unlawfully

AI features may send portions of your User Content to third-party model providers (such as OpenAI) as described in our Privacy Policy. Usage may be subject to plan limits, rate limits, and fair-use policies.

• You are responsible for final content submitted to employers or published online
• We do not guarantee interviews, offers, or hiring outcomes
• We may log prompts and outputs to improve safety, quality, and abuse prevention

Video mock interviews may be facilitated through third-party real-time communication providers. By starting a session, you consent to processing of audio/video as needed to deliver the feature.

• Recordings, if enabled, are stored to provide playback and feedback
• Do not record sensitive personal data of third parties without consent
• You must use interview tools in a private, appropriate environment
• We may remove recordings that violate these Terms or applicable law

The Service, including software, design, logos, templates, prompts, documentation, and trademarks (including Resume.win and related marks), is owned by Wackywow.com LLC or its licensors and protected by intellectual property laws. Except for the limited rights expressly granted, no license is transferred to you.

• You may not copy, modify, distribute, or create derivative works of our software or branding except as allowed by law or written permission
• You may not register confusingly similar domains, social handles, or app listings that impersonate $Resume.win
• Sister-brand names (including Recruit.win) remain separate products; using one brand to misrepresent the other is prohibited
• Feedback you provide may be used by us without restriction or compensation

The Service integrates with third parties (e.g., payment, AI, email, video, analytics). Your use of those services may be governed by their terms. We are not responsible for third-party websites, job boards, or employer application systems you access through links you save in Resume.win.

Our Privacy Policy explains how we collect and process personal data. By using the Service, you acknowledge that policy.

If you believe content on the Service infringes your copyright, send a notice to [email protected] including: identification of the work, the infringing material and its location, your contact information, a good-faith statement, and your signature (physical or electronic). We may remove content and terminate repeat infringers.

You may stop using the Service and request account deletion at any time. We may suspend or terminate access immediately for violations, risk to users or systems, non-payment, or legal requirements.

Upon termination, your right to use the Service ends. Provisions that by nature should survive (payment obligations, disclaimers, limitations, dispute resolution) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUME.WIN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless Resume.win and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

These Terms are governed by The laws of the United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.

Where permitted, disputes will be resolved through binding individual arbitration rather than in court, and you waive class or representative actions. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with subject "Arbitration Opt-Out."

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where appropriate, notified via email or in-app notice. Continued use after changes become effective constitutes acceptance.

• Entire agreement: These Terms and the Privacy Policy are the entire agreement regarding the Service
• Severability: If any provision is unenforceable, the remainder stays in effect
• No waiver: Failure to enforce a provision is not a waiver
• Assignment: We may assign these Terms; you may not assign without our consent
• Force majeure: We are not liable for delays due to events beyond reasonable control
